Olovlig försäljning av alkohol ansågs inte såsom sådan överlåtelse som avses i 95 § 4 mom. alkohollagen av 26.7.1968. Av alkoholbolaget tillverkad, olovligen såld alkoholdryck, som beslagtagits hos köparen och för vars innehav köparen inte skulle ådömas straff, förklarades med stöd av 95 § 1 mom. 2 punkten sagda lag förbruten i brottmålsrättegång mot säljaren.
